1. Scope & Provider
These Terms of Use govern your use of the obidience web application, which is developed and operated by Alexander Scherer, Scharfland 75, 48683 Ahaus, Germany (e-mail: info@schealex.de) as a private hobby project.
obidience is not a commercial business; it is an independent solo project maintained in the operator's spare time. By registering or using the service, you accept these Terms of Use.
2. Subject Matter / Service Description
obidience is a private, access-gated web application for consenting adults (18+) who wish to structure their consensual relationship dynamic — for example through rules, tasks, rituals, protocols, and journals.
The service is expressly not a pornography offering, not a dating or matchmaking platform, and not an escort or cam service. All content is user-generated, kept private, and is never made publicly accessible.
The available features may change over time. The operator reserves the right to extend, restrict, or discontinue individual features at any time.
3. Registration & Contract Formation
Creating a user account and linking with a partner via invite code are free of charge. Access to paid features requires an active subscription.
The paid contract is concluded by the order with payment obligation on /subscribe (§ 312j of the German Civil Code, BGB). You will be clearly informed of the total price before completing the order, and by clicking the order button you confirm your payment obligation.
After the contract is concluded, you will receive a confirmation e-mail with the essential contract details (§ 312f BGB).
4. Prices & Payment
The subscription costs €9.90 per month. New users may try the service free of charge for 7 days; thereafter €9.90 per month will be charged automatically unless the subscription is cancelled beforehand.
Billing is monthly and recurring via the payment service provider Stripe. By entering your payment details and confirming the order, you authorise Stripe to charge the amount due on a recurring basis.
Small-business regulation (§ 19 UStG): The operator is a Kleinunternehmer within the meaning of § 19 of the German VAT Act (UStG). Accordingly, no value-added tax is charged or shown on invoices.
Founding price guarantee: Early subscribers keep the price of €9.90/month for the lifetime of their subscription, provided it is not interrupted.
5. Term & Cancellation
The subscription runs on a monthly basis and renews automatically unless cancelled in time. There is no minimum contract period.
Cancellation is possible at any time with effect from the end of the current billing period. You can cancel via the cancellation button ('Cancel contract here') at /kuendigen (§ 312k BGB) or directly through the Stripe customer portal.
After a valid cancellation, access remains active until the end of the already-paid billing period.
6. Right of Withdrawal
Consumers have a statutory right of withdrawal. Details of the right of withdrawal and the model withdrawal form can be found at /widerruf.
Notice pursuant to § 356 (5) BGB: For digital services, the right of withdrawal expires if you have expressly agreed that performance of the contract begins before the end of the withdrawal period, and you have acknowledged that you will thereby lose your right of withdrawal.
7. Acceptable Use
Use of obidience is permitted only to adults aged 18 or over. Use must at all times be consensual and in compliance with applicable law.
It is prohibited to post unlawful, offensive, or morally objectionable content, or to process personal data of third parties without their express consent.
Any misuse of the service — including use for non-consensual acts or to circumvent legal requirements — is forbidden and may result in immediate account suspension.
8. Liability & Warranty
obidience is an independent hobby project, developed and operated by a single individual in their spare time. The service is provided with the greatest possible care, but without any guarantee of uninterrupted, error-free, or permanent availability. Individual features may change, be limited, or be discontinued at any time.
The software is provided "as-is" without express or implied warranty of any kind. Please back up important content regularly using the export function available in the app.
To the extent permitted by law, the operator's liability for damages is limited to intent and gross negligence. In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited in amount to the foreseeable damage typical for this type of contract. No liability is assumed for the loss of data, to the extent permitted by law.
This limitation does not apply to liability for damages arising from injury to life, body, or health, from the assumption of a guarantee, from fraudulently concealed defects, or under the German Product Liability Act (Produkthaftungsgesetz).
9. Changes to These Terms
The operator reserves the right to amend these Terms of Use with reasonable notice. Changes will be communicated to users in good time — generally at least 30 days before they take effect — by e-mail or by a notice within the app.
Each valid version of these Terms carries a version number in the form of a date (see "Last updated" above). The version in force at the time of contract conclusion or the latest change notification applies.
10. Applicable Law & Miscellaneous
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these Terms be or become wholly or partially invalid, the validity of the remaining provisions is not affected (severability clause). The invalid provision shall be replaced by the legally permissible rule that comes closest to the economic purpose of the invalid provision.
